Sustainability Through Your Own Lens Photography Competition Terms and Conditions of Entry

1. Terms and Conditions

1.1 The ResourceSmart Schools program (RSS) and the RSS Photography Competition (the Competition) is run and managed by Sustainability Victoria (SV).

1.2 These Competition Terms and Conditions of Entry (Terms) apply to all entries to the Competition (Entry/Entries). These Terms include the information and instructions in the online Competition entry form.

1.3 Entry to the Competition (Entries or Entry) is open to all Department of Education and Training registered primary and secondary schools located within Victoria that meet the eligibility criteria in paragraph 3 (Participating School/s).

1.4 By submitting an Entry/Entries, Entrants acknowledge that they have read, understood and agree, and are authorised to agree, on behalf of the Participating School, to be bound by these Terms and Conditions.

2. Key Dates:

2.1 Entries close at 5:00pm on 28 March 2024.

2.3 Winners will be announced and the winners notified at the ResourceSmart Schools Award Event in June 2024 (“RSSA Event”).

3. Eligibility Criteria and Entrance Requirements

3.1 To be eligible to participate in the Competition, Participant Schools must be ‘active’ in ResourceSmart Schools program between 1 July 2023 to 28 March 2024. The Participant School must have accessed their ResourceSmart Schools Online account and either completed an action, entered a comment or a bill or uploaded a document as evidence. A Participant School is not required to have achieved ResourceSmart School star ratings to participate in the Competition.

3.2 Entries must be submitted by a Teacher from the Participating School.

3.3 Each Teacher is permitted to submit one Entry per year level into the Competition.

3.4 There may be multiple Entries submitted on behalf of the same Participating School, provided Clauses 3.2 and 3.3 of these Terms are complied with.

3.5 Each Entry from a Participating School can include submission one photograph.

3.6 Schools must identify on application whether they are entering into the Lower Primary, Middle Years or Senior School categories.

3.7 The Photograph submissions must respond to the Challenge Activity identified in the Entry form.

3.8 The school must be located in Victoria and Entries must demonstrate that the Challenge Activity associated with the photograph submission were created within Victoria.

3.9 SV employees and their immediate families, and SV contractors involved in the RSS are not eligible to submit Entries.

3.10 Entries that are unlawful, offensive, defamatory, obscene, contain animal cruelty or criminal activity are not eligible and SV reserves the right, in its absolute discretion, to reject and delete entries which violate these standards.

3.11 To enter the Competition, entrants must complete the Survey Monkey Competition submission form. In order for an entry to be valid, all entry fields must be completed, and entries must otherwise comply with the requirements of these Terms and Conditions including format, content, lodgement method, closing time, as well as complying with the SV ICT acceptable usage policy for external users. Illegible, incomplete, late or non-compliant entries are invalid and will not be accepted.

3.12 Entrants warrant that the information in the entry is to the best of their knowledge true and correct, and does not contain any defamatory or offensive content or infringe third party intellectual property rights. Entrants will notify Sustainability Victoria of any changes to the information and any circumstances that may affect the entry. Sustainability Victoria reserves the right to verify the validity of Entries and may disqualify a Participating School or an Entry if it discovers or determines that an entry does not comply with these Terms and Conditions, an entrant has provided dishonest or incorrect information in its Entry or that an Entry contains defamatory or offensive content or infringes third party intellectual property rights.

3.13 At its sole discretion, SV reserves the right to determine the eligibility of entries in the Competition.

4. Prizes and Notification of Competition Winners

4.1 The Entries will be assessed on their merit based on the selection criteria. Each photograph submission will be assessed individually.

4.2 Competition Winners will be selected by SV’s judging panel (1 winner from the Lower Primary, 1 winner from the Middle Years and 1 winner from the Senior School category.) along with 2 finalists from each category. The judges’ decision is final and no correspondence will be entered into.

4.3 Finalists will be notified and invited to attend the ResourceSmart Schools Awards 2024 in June 2024 (‘RSSA Event’). Children attending the RSSA Event are to be accompanied by an adult.

4.4 Prizes will be awarded to the Schools associated with the Competition Winners and finalists. Prizes will be distributed by email/mail within 28 days of the Competition Winners being announced.

5. General Competition Rules

5.1 Upon submission and subject to clause 5.6, Entries become the property of SV and will not be returned.

5.2 SV reserves the right, in its sole discretion and to the fullest extent permitted by law, to modify, suspend, terminate or cancel the Competition.

5.3 Sustainability Victoria may require the schools participating in the Competition to participate in marketing and promotional activities, including but not limited to media exposure and promotion without any payment or other compensation.

5.4 Entrants acknowledge that SV is subject to the Freedom of Information Act 1982 (Vic). If a Freedom of Information request is made, SV will consult with the Entrant before any decision is made to release the Entry or supporting documentation.

5.5 Entrants agree that SV may contact them during and after the Competition to seek information or comments about their Entry. Entrants acknowledge that Sustainability Victoria may refer Entries to external contractors or other government departments for reporting or advice.

5.6 Entrants acknowledge that Sustainability Victoria collects, uses and discloses personal information, in order to administer the Competition, the ResourceSmart Schools program and other SV initiatives (the “Purposes”) . All personal information is handled in accordance with privacy law and SV’s Privacy Statement.

5.7 SV may use, modify, adapt, publish and reproduce the intellectual property (except for any confidential information) in Entries (including any material provided by entrants in support of Entries at any time) in connection with the Competition or the broader general objectives of SV. Entrants warrant that (except where certain information is identified as confidential) Entries do not contain any confidential information. Entrants also warrant that they hold all necessary rights, consents and permissions to provide any personal information (including images of people) and to licence the use of the intellectual property contained in their entries on the terms set out in this clause. For the avoidance of doubt, the licence given by Entrants pursuant to this clause does not extend to any of the Entrants’ background intellectual property that led to the creation of the entry itself.

5.8 SV accepts no responsibility for late, lost or misdirected entries or for any technical difficulties or periods of unavailability of the Competition website.

5.9 SV will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained, (including negligence), , or otherwise, in connection with a school or students participation in the Competition, the Challenge activity or photograph submission, except for any liability which cannot be excluded by law. SV is not responsible for any tax implications that may arise from winning a Prize.

5.10 Entrants must not do anything that may damage, bring into disrepute or ridicule SV’s name, messages or reputation, or attract public or media attention which may be prejudicial or otherwise detrimental to SV’s name, messages or reputation. In particular, schools must be compliant with all equal employment, occupational health and safety and environmental laws.

5.11 While all care has been taken in preparing the online submission process, SV does not warrant the accuracy of the online submission process and accepts no liability for any deficiency within the online submission process.
