ResourceSmart Schools of the Future Challenge Competition Terms and Conditions of entry

  1. These Terms and Conditions of Entry (Terms and Conditions) include the information and instructions in the online submission form. By submitting an entry, Entrants agree, on behalf of the school, to be bound by these Terms and Conditions.
  2. Upon submission and subject to clause 20, entries become the property of Sustainability Victoria and will not be returned.
  3. To enter the ResourceSmart Schools of the Future Challenge Competition (Competition), Entrants must complete the ResourceSmart Schools of the Future Challenge and then log on to and follow the online submission instructions. In order for an entry to be valid, all entry fields must be completed, and entries must otherwise comply with the requirements of these Terms and Conditions including format, content, lodgement method closing time as well as complying with the SV ICT acceptable usage policy for external users. Illegible, incomplete, late or non-compliant entries are invalid and will not be accepted.
  4. Entrants will be required to create a user account (User Account) to submit their entries. By creating a User Account, Entrants agree:
    • that they are authorised by the school to create a User Account and agree to these Terms and Conditions;
    • to provide complete and accurate information when creating a User Account; and
    • that they are responsible for all activities that occur under the User Account, unless these activities arise due to Sustainability Victoria’s fault or negligence.
  5. Schools must meet the eligibility criteria included in the online submission process.
  6. There is no limit to the number of times a school may participate in the ResourceSmart Schools of the Future Challenge.
  7. Each school may only submit one entry into the Competition.
  8. To be eligible to participate in the Competition, schools must be active in ResourceSmart Schools program between 1 July 2020 to 30 June 2021. An active school has accessed their ResourceSmart Schools Online account and either completed an action, entered a comment or a bill or uploaded a document as evidence. A school is not required to have achieved ResourceSmart School star ratings to participate in the Competition.
  9. There will be 15 individual prizes awarded of $1000 each, which shall be awarded across the regions of Victoria at Sustainability Victoria’s discretion.
  10. All eligible schools who have met the entry criteria will be included in the Competition prize draw.
  11. Entrants warrant that the information in the entry is to the best of their knowledge true and correct, and does not contain any defamatory or offensive content or infringe third party intellectual property rights. Entrants will notify Sustainability Victoria of any changes to the information and any circumstances that may affect the entry. Sustainability Victoria reserves the right to verify the validity of entries and may disqualify a school or an entry if it discovers or determines that an entry does not comply with these Terms and Conditions, an Entrant has provided dishonest or incorrect information in its entry or that an entry contains defamatory or offensive content or infringes third party intellectual property rights.
  12. The school must be located in Victoria and entries must demonstrate that the Challenge activities associated with the entry subject were created within Victoria.
  13. At its sole discretion, Sustainability Victoria reserves the right to determine the eligibility of entries in the Competition. In the case of disputes regarding the drawing of the prize winners, Sustainability Victoria’s decision is final, and no correspondence will be entered into.
  14. If the ResourceSmart Schools of the Future Challenge or Competition are interfered with in any way, are not capable of being conducted as reasonably anticipated due to any reason beyond Sustainability Victoria’s reasonable control or where Sustainability Victoria is required or directed to do so by the Victorian Government, Sustainability Victoria reserves the right, in its sole discretion and to the fullest extent permitted by law, to modify, suspend, terminate or cancel the Challenge or the Competition.
  15. Winners of the Competition will be notified by email and published on the ResourceSmart Schools web page within 7 days of the prize draw.
  16. Winners will be required to provide their school bank details within 14 days to receive the prize. Prizes will be distributed within 28 days of receipt of the banking details.
  17. Sustainability Victoria may require the schools participating in the Competition to participate in marketing and promotional activities, including but not limited to media exposure and promotion without any payment or other compensation. If requested, winners will provide all reasonable assistance and cooperation to Sustainability Victoria in the preparation of case studies and other material or promotion of the Competition or Sustainability Victoria’s use generally.
  18. Entrants acknowledge that Sustainability Victoria is subject to the Freedom of Information Act 1982 (Vic). If a Freedom of Information request is made, Sustainability Victoria will consult with the Entrant before any decision is made to release the entry or supporting documentation.
  19. Entrants agree that Sustainability Victoria may contact them during and after the Competition to seek information or comments about the Challenge and Competition. Entrants acknowledge that Sustainability Victoria may refer entries to external contractors or other government departments for reporting or advice. Entrants acknowledge that Sustainability Victoria collects, uses and discloses their personal information as specified in the Competition online submission process, in order to process entries and in accordance with its Privacy policy.
  20. Sustainability Victoria may use, modify, adapt, publish and reproduce the intellectual property (except for any confidential information) in entries (including any material provided by Entrants in support of entries at any time) in connection with the Competition or the broader general objectives of Sustainability Victoria. Entrants warrant that (except where certain information is identified as confidential) entries do not contain any confidential information. Entrants also warrant that they hold all necessary rights, consents and permissions to provide any personal information (including images of people) and to licence the use of the intellectual property contained in their entries on the terms set out in this clause. For the avoidance of doubt, the licence given by Entrants pursuant to this clause does not extend to any of the Entrants’ background intellectual property that led to the creation of the entry itself.
  21. Sustainability Victoria accepts no responsibility for late, lost or misdirected entries or for any technical difficulties or periods of unavailability of the Competition website.
  22. Sustainability Victoria will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, in connection with a school’s participation in or the conduct of the Challenge and Competition except for any liability which cannot be excluded by law.
  23. Entrants must not do anything that may damage, bring into disrepute or ridicule Sustainability Victoria’s name, messages or reputation, or attract public or media attention which may be prejudicial or otherwise detrimental to Sustainability Victoria’s name, messages or reputation. In particular, schools must be compliant with all equal employment, occupational health and safety and environmental laws.
  24. While all care has been taken in preparing the online submission process, Sustainability Victoria does not warrant the accuracy of the online submission process and accepts no liability for any deficiency within the online submission process.
