1. Terms and Conditions
These terms and conditions (Terms) apply to any person (a Participant) who enters a Better Bag Habits mini-competition (Competition) through a Competition post on the Sustainability Victoria Facebook page (Facebook Page). By entering the Competition, Participants agree to be bound by these Terms including the disclaimer of Facebook’s association at 6.3 and intellectual property assignment at 5.3.
2. Eligibility and Prizes
a) are Victorian residents;
b) are over the age of 18 years old; and
d) submit an entry by writing a comment under the Facebook post where the Competition is advertised, answering the Competition entry question will be eligible to win a T-shirt or bag (Prize).
Sustainability Victoria (SV) will award the Prize to the eligible Participant who, in the sole opinion of SV, has posted the best response to the Competition entry question.
3. Key Dates
3.1 The closing date and time for entry into the Competition will be as stated in the Competition post. Any entries received after that date and time will not be eligible.
3.2 The winners of a Prize will be announced within the Competition post within 2 business days of the closing date.
4. Notification of Competition Outcome
4.1 Prize winners will be notified of the outcome of the Competition by Facebook private message and will be asked to provide their contact details for delivery of the Prize. In this message, SV may also seek the consent of the Prize winner to supply an image of themselves for use on the Page and for publication of their name and answer.
4.2 If a Prize winner does not provide their contact details to SV within 7 days of receiving a message from SV notifying them of the outcome of the Competition and requesting them to provide such contact details:
a) that Prize winner will lose his or her right to claim the Prize; and
b) the Prize will be awarded to the next placed Participant and that original Prize Winner’s Prize will be transferred to that Participant.
5. General Rules for the Competition
5.1 Participants may only enter once.
5.2 Prizes are not transferable, negotiable, exchangeable or redeemable for cash. SV takes no responsibility for any variation in the value of the Prize or for Prizes that are damaged or lost in transit.
5.3 SV has sole discretion to determine the eligibility of entries and to award the Prizes. In the event of a dispute, the decision of SV is final and no correspondence will be entered into. Any failure by SV to enforce any of its rights at any stage does not constitute a waiver of those rights.
5.4 SV will own the intellectual property rights in all Competition entries. SV may publish Competition entries on the Facebook or the campaign website after the Competition has closed. If your entry is published by SV, your first name will appear beside it to acknowledge you as author.
5.5 If a Prize winner does not accept any element of a Prize, SV is not obliged to provide that winner with a substitute prize.
5.6 Employees of SV and their immediate families and contractors of SV associated with the Better Bag Habits campaign are not eligible to enter the Competition.
5.7 SV will hold no responsibility for the Prizes after they have been received by the Prize winner.
5.8 Unless otherwise required by law, any personal information provided by Participants in connection with the Competition including Participant names, ages, images or contact details will only be used by SV in connection with the Competition and only in accordance with these Terms and the SV Privacy Statement available at http://www.sustainability.vic.gov.au/privacy.
6.1 SV will not be liable for any loss or damage whatsoever or for any personal injury suffered or sustained, including as a result of negligence, in connection with the conduct of the Competition or the redemption or use of any Prize except for any liability which cannot be excluded by law. SV accepts no responsibility for any tax implications that may arise from winning a Prize.
6.2 If the Competition is interfered with in any way, is unable to be conducted as reasonably anticipated due to any reason beyond the reasonable control of SV or if it is fair and reasonable to do so or where SV is required or directed to so by the Victorian Government, SV reserves the right, in its sole discretion, to the fullest extent permitted by law, to modify, suspend, terminate or cancel the Competition, as appropriate.
6.3 The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering the Competition, Participants agree to release Facebook from all responsibility or liability associated with the Competition.
